1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of HAVEN, a food social platform operated by Breachora ("we," "us," or "our"), including the HAVEN mobile application and website at havenlifestyle.app (collectively, the "Service").
By creating a HAVEN account, accessing the Service, or using any feature of HAVEN, you agree to these Terms in full. If you do not agree with any part of these Terms, you may not use the Service.
These Terms form a binding legal agreement between you and Breachora. We recommend reading them in full. If something is unclear, contact us at breachora@gmail.com before using the Service.
2. Eligibility
You must be at least 13 years old to create a HAVEN account or use the Service. By using HAVEN, you represent and warrant that you are 13 or older.
If you are between 13 and 18 years old, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf, or that you have the legal capacity to enter into a binding agreement in your jurisdiction.
You may not use HAVEN if you have previously been banned or suspended from the platform, or if you are prohibited from receiving services under the laws of the United States or your applicable jurisdiction.
3. Your Account
3.1 Account Creation
To use most features of HAVEN, you must create an account. You agree to provide accurate, complete, and current information when registering. You are responsible for maintaining the accuracy of your account information.
3.2 Account Security
You are responsible for safeguarding your password and for all activity that occurs under your account. You agree to notify us immediately at breachora@gmail.com if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
3.3 One Account Per Person
You may not maintain more than one personal account. You may not create an account on behalf of another person without their authorization. Accounts for businesses, restaurants, and brands may be created separately and are subject to business verification requirements.
3.4 Username Policy
Your username must not impersonate another person, brand, or entity. You may not use a username that implies affiliation with HAVEN or Breachora (e.g., "HAVENofficial," "Breachora"). We reserve the right to reclaim usernames that violate this policy.
4. Content & Ownership
4.1 Your Content
You retain full ownership of the content you post on HAVEN, including photos, captions, dish information, and any other original material ("User Content"). These Terms do not transfer ownership of your content to Breachora.
4.2 Your Responsibility
You are solely responsible for the content you post. By posting on HAVEN, you represent and warrant that:
- You own or have the necessary rights to post the content
- The content does not violate any third party's intellectual property rights, privacy rights, or other legal rights
- The content does not violate these Terms or applicable law
- Photos you post are of food you have actually eaten or food you have legitimately photographed
4.3 Content Standards
All content on HAVEN must be food-related and appropriate for a general audience. Content that is off-topic, spam, or violates our prohibited conduct rules (Section 6) may be removed.
5. License Grant to HAVEN
By posting content on HAVEN, you grant Breachora a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, distribute, and prepare derivative works of your User Content solely for the purposes of:
- Operating and providing the HAVEN platform and its features
- Displaying your content to other users, including in feeds, restaurant pages, and search results
- Generating aggregated statistics (such as restaurant average scores)
- Promoting HAVEN, using content with your consent (we will always seek explicit permission before using your content in marketing campaigns)
This license ends when you delete your content or your account, subject to the retention period described in our Privacy Policy. We do not use your content to train AI models without your explicit consent.
6. Prohibited Conduct
You agree not to use HAVEN to:
6.1 Spam & Inauthentic Activity
- Post duplicate or near-duplicate content repeatedly
- Use bots, scripts, or automation to create posts, generate likes, or inflate follower counts
- Purchase followers, likes, or other engagement signals
- Create multiple accounts to evade enforcement or inflate your reach
- Post content that is not genuinely your own food experience (fake reviews, staged posts intended to deceive)
6.2 Harassment & Harmful Content
- Harass, threaten, bully, or intimidate any user
- Post content that is hateful toward individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality
- Doxx another person (share their private information without consent)
- Impersonate any person, brand, or entity in a way that misleads others
6.3 Prohibited Food Content
- Post photos that are not of food or food-adjacent subjects
- Post sexually explicit content
- Post graphic violence or disturbing content not related to food preparation in a culinary context
- Use food posts to promote illegal products or substances
- Post fake or fabricated restaurant scores or reviews intended to harm a business's reputation
6.4 Legal Violations
- Post content that infringes on any person's copyright, trademark, or other intellectual property rights
- Post content that violates any person's privacy rights
- Use HAVEN to conduct or facilitate any illegal activity
- Attempt to gain unauthorized access to any part of the Service or another user's account
- Reverse engineer, decompile, or attempt to extract the source code of the HAVEN app
6.5 Platform Integrity
- Manipulate or interfere with the proper functioning of the app
- Use HAVEN in any manner that could damage, disable, overburden, or impair the Service
- Scrape, crawl, or extract data from HAVEN in bulk without written permission
7. Verification Rules
7.1 Individual Verification
Individual verification is a badge granted to eligible HAVEN users who meet our published requirements. Verification does not confer any special legal status, editorial authority, or employment relationship with Breachora. Verification indicates that an account is authentic and meets our community activity standards โ nothing more.
To apply for individual verification, you must meet all four requirements: account at least 14 days old, at least 3 posts shared, a bio on your profile, and at least 200 followers. Applications are reviewed manually and at our sole discretion.
We may deny verification for any reason and are not obligated to provide explanations for denials.
7.2 Verification Can Be Revoked
Verification may be revoked at any time if:
- Your account falls below the requirements (e.g., follower count drops below 200)
- You violate these Terms of Service
- You engage in behavior that, in our judgment, undermines the trust the verification badge is intended to represent
- You provided false information in your verification application
7.3 Business Verification
Business verification is a separate program for restaurants, food brands, and food media organizations. Business accounts are subject to additional requirements and review. We reserve the right to revoke business verification status at any time for Terms violations or if the account no longer qualifies.
7.4 Misuse of Verification
You may not represent your verification status in a misleading way. You may not attempt to transfer verification to another account. Attempting to fraudulently obtain verification (e.g., temporarily meeting requirements with bought followers) will result in permanent account suspension.
8. Restaurant & Business Content
HAVEN creates restaurant pages automatically from community posts. Restaurant pages display aggregated information โ average scores, top dishes, post history โ that reflects community sentiment.
Businesses may claim their restaurant page through the business verification process. Claiming a page does not allow businesses to remove legitimate community posts, alter user scores, or edit user-generated content.
Restaurant pages are not editorial reviews and do not represent the opinions of Breachora. HAVEN provides this information as community-sourced data. Scores and posts reflect individual user experiences and opinions.
9. Third-Party Content & Links
HAVEN may display links to third-party websites or content. We do not control and are not responsible for the content, privacy practices, or terms of any third-party websites. Accessing third-party links from HAVEN is at your own risk.
Restaurant data is sourced in part from Google Places API. We are not responsible for the accuracy of Google-sourced restaurant information.
10. Copyright (DMCA)
HAVEN respects intellectual property rights. If you believe content on HAVEN infringes your copyright, you may submit a DMCA takedown request to:
Your request must include: a description of the copyrighted work; a description of where the infringing content appears on HAVEN; your contact information; a statement that you have a good faith belief the use is not authorized; a statement under penalty of perjury that your claim is accurate; and your electronic or physical signature.
We will respond to valid DMCA requests promptly. Repeat infringers may have their accounts terminated.
11. Termination
11.1 Termination by You
You may delete your account at any time from Settings โ Account โ Delete Account. Deletion is permanent. Upon account deletion, your posts will be removed and your account will be deactivated per the timeline described in our Privacy Policy.
11.2 Termination by Us
We may suspend or permanently terminate your account at any time, with or without notice, if:
- You violate these Terms of Service
- We determine, in our reasonable judgment, that your use of HAVEN poses a risk to the platform, to other users, or to Breachora
- You engage in activity that violates applicable law
- We are required to do so by law or court order
If your account is terminated for Terms violations, you may not create a new HAVEN account without our express written permission.
11.3 Effect of Termination
Upon termination, your right to use the Service immediately ceases. We have no obligation to provide you with a copy of your content after termination, though we will honor valid data export requests submitted before termination is executed.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BREACHORA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy or completeness of any content on the platform, including user-generated food scores, restaurant information, or dish descriptions.
HAVEN is a community-powered platform. We do not verify the accuracy of individual posts or food scores. Reliance on any content on HAVEN โ including restaurant pages, food scores, or ingredient information โ is at your own risk.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BREACHORA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY) OR (B) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Breachora and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any third party's rights
- Your violation of applicable law
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States. To the extent permitted by law, any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Breachora.
If any provision of this arbitration clause is found unenforceable, the remaining provisions shall remain in force, and disputes shall be resolved in the applicable courts of the United States.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app and/or by email at least 14 days before the changes take effect, unless the changes are required by law and cannot be delayed.
Continued use of HAVEN after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with updated Terms, you should delete your account before the changes take effect.
